User acknowledges that: (i) The WDC Website contains information, images, text, software, photos, video, graphics, music, sounds, and other material and services (collectively "Content");   or other materials found in the WDC Web Site is strictly prohibited. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior written permission of WDC. (ii) Such Content is provided under license by WDC and its affiliates; (iii) At minimum, WDC owns a copyright in the selection, coordination, arrangement, and enhancement of such Content; (iv) WDC permits access to Content that is protected by copyrights, trademarks, and other intellectual and proprietary rights ("Rights"); (v) These Rights are valid and protected in all media and technologies existing now or later developed; and (vi) Except as explicitly provided otherwise, this Agreement, applicable copyright and other laws govern user’s use of Content.

User acknowledges that neither WDC nor its affiliates shall assume or have any liability for any action or inaction by WDC or its affiliates,  with respect to Content on, or Content changes within, WDC Website.

WARRANTY

User expressly agrees that the use of the WDC website is at user’s sole risk. the WDC website and content are provided "as is" and "as available" for user’s personal use, without warranties of any kind, either express or implied, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement, unless such warranties are legally incapable of exclusion. in no event shall WDC and  its affiliated companies be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with the use of the WDC website or with the delay or inability to use the WDC website.

ACCURACY OF INFORMATION:

While all reasonable attempts are made to ensure the accuracy of the information, neither WDC , nor its information contributors can be held responsible by USER for the accuracy of the information found in the WDC Web Site. WDC  makes no expressed or implied warranty as to the accuracy or merchantability of content.

INDEMNIFICATION

User agrees to defend, indemnify and hold harmless WDC, its affiliated companies, its employees, contractors, officers, directors from all liabilities, claims and expenses, including attorneys fees, that arise from user’s use of the WDC Website.

INFRINGEMENT NOTICE

WDC respects the intellectual property of others, and we ask our members to do the same. If user believes that user’s Work , Trade marks, or Logos has been copied and is accessible on the WDC service in a way that constitutes copyright infringement, user may notify WDC by providing WDC's copyright agent the following information:
1. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
2. a description of the copyrighted work that user claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work;
3. identification of the URL or other specific location on the WDC site where the material that user claim is infringing is located;
4. user’s address, telephone number, and email address;
5. a statement by user that user have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
6. a statement by user, made under penalty of perjury, that the above information in user’s Notice is accurate and that user are the copyright owner or authorized to act on the copyright owner's behalf.
